Terms of Service
DaboSoft

These Terms of Service (the “Terms”) govern your access to and use of games, websites, applications, and related services offered by DaboSoft (“DaboSoft,” “we,” “us,” or “our”) (the “Services”). By downloading, installing, accessing, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
Our Privacy Policy describes how we collect and use information and is incorporated by reference.
1. Eligibility
You must be able to form a binding contract to use the Services. The Services are not directed to children under 13, or under 16 where that is the applicable age, unless a specific product states otherwise. If you are under the age of majority where you live, you may use the Services only with the consent of a parent or legal guardian who agrees to these Terms.
You are responsible for complying with the laws that apply to you, including export and game-rating rules.
2. Limited license
Subject to these Terms, DaboSoft grants you a personal, limited, revocable, non-exclusive, non-transferable, non-sublicensable license to download, install, and use the Services for your own entertainment on devices you own or control.
You do not own the Services or any content in them. All rights not expressly granted are reserved by DaboSoft and its licensors.
You may not:
- copy, modify, distribute, sell, rent, lease, or sublicense the Services;
- reverse engineer, decompile, or attempt to extract source code, except to the extent that applicable law expressly allows it and you first give us written notice;
- bypass, disable, or interfere with security, access controls, anti-cheat, or technical protection measures;
- use cheats, exploits, bots, automation, unauthorized third-party software, or modified clients;
- scrape, harvest, or mine data from the Services except as we expressly allow;
- use the Services for any commercial purpose without our prior written consent;
- remove or alter copyright, trademark, or other proprietary notices.
3. Display names, saves, and leaderboards
Some features let you choose a display name or handle, submit scores, and store game-save data.
You are responsible for the name you choose and for activity associated with it. Do not impersonate others or use a name that is unlawful, misleading, or infringing.
Leaderboard entries (typically a score and the name you attach to it) may be public. We may remove, hide, reset, or refuse entries that we reasonably believe are fraudulent, abusive, obtained by cheating, or otherwise in violation of these Terms.
Game saves and leaderboards are provided as a convenience. We do not guarantee that progress, scores, or rankings will be stored forever, remain available on every device or platform, or survive updates, outages, or discontinuation of a feature or Service.
4. Purchases and virtual items
We do not collect payment card numbers. Purchases made through an app store, platform, or other store are processed by that store under its terms and privacy policy.
If a Service offers paid content, virtual currency, or other virtual items, those items are licensed to you, not sold. They have no cash value, are not redeemable for money, and may be modified, limited, or withdrawn. Except where required by law or by the store’s refund rules, purchases are final.
Platform account, billing, and refund issues should be directed to the store through which you purchased.
5. Acceptable use
You agree not to use the Services to:
- violate any law or the rights of others;
- harass, threaten, defame, or abuse other players or DaboSoft;
- upload or transmit malware or harmful code;
- interfere with or disrupt the Services, servers, networks, or other players’ enjoyment of the game;
- cheat, farm, or manipulate leaderboards, matches, economies, or progression;
- probe, scan, or test the vulnerability of the Services except with our written permission;
- use the Services in any way that could damage our reputation or the integrity of the game.
We may investigate suspected violations and take action we consider appropriate, including removing content, resetting progress or scores, suspending access, or contacting platforms or authorities.
6. User content
If you submit, post, or otherwise provide content through the Services (including display names, support messages, and similar material), you retain whatever ownership rights you have in that content. You grant DaboSoft a worldwide, royalty-free, sublicensable license to host, store, reproduce, display, and otherwise use that content as needed to operate, secure, promote, and improve the Services.
You represent that you have the rights needed to grant that license and that your content does not infringe others’ rights or violate these Terms.
We may remove content at our discretion.
7. Intellectual property
The Services, including games, software, art, audio, text, trademarks, logos, and other materials, are owned by DaboSoft or its licensors and are protected by intellectual property laws.
“DaboSoft” and related names and marks are trademarks of DaboSoft. You may not use them without our prior written permission.
If you believe content in the Services infringes your copyright, contact us at privacy@dabosoft.com with enough detail for us to identify the material and evaluate the claim.
8. Platforms and third-party services
The Services may be distributed through or interoperate with app stores, game engines, platforms, cloud hosts, and other third parties. Those parties’ terms and policies also apply. We are not responsible for third-party services we do not control.
Your use of a platform account is governed by that platform.
9. Updates, availability, and changes to the Services
We may update, patch, modify, suspend, or discontinue all or part of the Services at any time, including features, content, leaderboards, and online functionality. We may do so for security, legal, technical, business, or design reasons.
The Services may be unavailable from time to time. We do not warrant uninterrupted or error-free operation.
10. Feedback
If you send ideas, suggestions, or feedback, you grant DaboSoft a perpetual, irrevocable, royalty-free right to use them without restriction or compensation to you.
11. Disclaimer of warranties
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, DABOSOFT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Services will meet your expectations, that scores or saves will be accurate or preserved, or that defects will be corrected.
Some jurisdictions do not allow certain warranty exclusions. In those places, the above limitations apply only to the extent permitted.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DABOSOFT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR GAME PROGRESS, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US, IF ANY, FOR THE RELEVANT SERVICE DURING THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) USD $50.
These limitations do not apply to liability that cannot be limited under applicable law, including liability for death or personal injury caused by negligence where such limitation is prohibited.
13. Indemnity
You will defend, indemnify, and hold harmless DaboSoft and its officers, directors, employees, and agents from and against claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Services, your content, or your violation of these Terms or applicable law.
14. Termination
You may stop using the Services at any time.
We may suspend or terminate your access immediately if you violate these Terms, if required by law or a platform, or if we discontinue a Service.
Upon termination, the license granted to you ends. Sections that by their nature should survive (including intellectual property, disclaimers, limitations of liability, indemnity, and governing law) will survive.
15. Changes to these Terms
We may update these Terms from time to time. The effective date above will change when we do. If a change is material, we will provide additional notice in the Services or on this page. Continued use after the updated Terms take effect constitutes acceptance.
16. Governing law
These Terms are governed by the laws of the State of Delaware, USA, excluding its conflict-of-law rules, except where mandatory local consumer law in your country of residence requires otherwise. That local law will then apply to the extent required.
Courts located in Delaware will have exclusive jurisdiction over disputes, except that:
- you may bring qualifying consumer claims in your country of residence where required by law; and
- we may seek injunctive or other equitable relief in any jurisdiction to protect our intellectual property or the integrity of the Services.
If a provision of these Terms is held unenforceable, the remaining provisions will remain in effect.
17. General
These Terms, together with the Privacy Policy and any additional terms for a specific game or feature, are the entire agreement between you and DaboSoft regarding the Services and supersede prior agreements on that subject.
You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
Our failure to enforce a provision is not a waiver.
No agency, partnership, or joint venture is created by these Terms.
